Rear end collision taken to arbitration
I just had a claim finally resolved after months of ridiculousness and was curious as to how common my experience is and insight as to why it happened this way.
A teenager rear ended me back in April. I saw her in my rearview flying up behind me, looking at her phone. I rolled my car forward as far as I could without hitting the car in front of me and she slammed the brakes right before she was about to hit me. As soon as the light turned green, she floored it and slammed right into me. I figured this claim was pretty cut and dry with nothing to debate but, for some reason, the claim went to arbitration where she was ultimately found to be 100% at fault.
I’m wondering, who makes the decision to take such a clear cut case to arbitration? Is it something that she or her parents had to request for or does the insurance company make that call? It seems like a massive waste of time and resources when there’s nothing to even debate.
