PSA: Is Process Service a Scam?
I am a Private Investigator and work for a process service company in Utah County. A lot of people posting on this platform are asking if Process Service is a scam. Here is the answer to that question:
No, Process Service is not a scam. It's a legitimate legal system that's been around for hundreds of years. All of the legitimate process service companies in this area have been doing it for 40+ years. This includes legit companies like RPS, Statewide, TD's, Anderson, PrivateOPS, and others. However, just like any field, some scams can exist. If the process server asks you for money, that's a scam (for example). But if a Process Server is simply giving you papers, it's not a scam.
Process Service is where someone is suing you. It's a notification to you that you need to show up in court. Process Servers drive around and hand people legal papers. These papers have all of the information about the court case, etc.
The Process Server Act, [Utah Code Title 78B, Chapter 8, Part 3] Discusses the responsibilities of a process server in Utah.

Also, please accept service! [just take the papers they give you]. Besides denial of service being against the law, many of us process servers are paid commission-only. If we're not able to reach you the first time, we usually have to come back 4-6 seperate days. With how crazy gas prices are, it can really make it difficult for us if you don't take the papers. If someone leaves you a note on your door, promptly send them a text [they are often driving and can't answer a phone call]. Schedule a time they can drop off. Don't worry about texting them at night/on a weekend/etc. We work really weird hours and want to get paid!
This includes people who moved out. If you recently moved in, and someone is trying to serve a previous resident, just text the server!! They can get paid if it's a bad address. But, if you don't text them, they will have to keep coming back several times (using their own gas expense, which is crazy high!)
Again, texts are always better than calls since we're always driving!

Also, process service is not associated with ICE or immigration. Don't worry about that, we are not affiliated with the government, we are mostly working for private debt collection firms.
