I understand that assault is attempted battery; so why was attempted murder incorrect in the first question, but attempted battery (i.e., assault) was correct in the second question?

Maybe I'm missing something, but both fact patterns depict an act of someone paying another to commit murder/battery and both adopt the common law.

Am I missing something here??

Is it worth dedicating a lot of time memorizing rules for the essay questions (via flashcards or outlining), or is it better to spend that time doing practice questions and following the Themis course? For context, taking CA Bar
