Spark Drivers in the Breakroom

Hey! So we have a particular spark driver at my store who is a bit notorious. He rushes around both the store AND the town in his car driving recklessly, he is rude and has been reported to be racist on occasion, and he has already had his account banned and reinstated before.

This driver has been seen on several different occasions in our breakroom, and when he was told he needed to leave previously he said that our store manager said he had permission to use our breakroom.

I saw him in there again today and decided I would check with my AP Coach on the policy, and she informed me that according to Walmart, the drivers are Walmart employees and are therefore allowed to used employee amenities. This, however, seems conflicting to me as I have heard several advertisements played in the store that explicitly state that spark drivers are not Walmart employees. I also worked for the OGP department for a year and have lots of experience telling customers we can't deal with express spark orders specifically because the drivers aren't our employees and have a separate customer care service, so i was already under the impression they were contracted gig drivers and not official Walmart employees.

I wanted to dig around the policy for myself but it is way too busy today and it is my Friday so I won't be able to for a few days. I thought, in the meantime, I would post here and ask what other employees at other stores have experienced and what they know. Im still gonna dig around after my Monday but I'd be interested to know what others have to say!
