Is Abuse (1996) in public domain?

I keep getting mixed results saying that the main character is or isn't or that the game is partially in public domain from source code & shareware data.

Dude, idk what any of that means, i just need a simple answer if the Abuse game is in public domain or at least the main character then for my own multiverse of stories kind of ordeal

Can I still use the original 1949 Ghost Rider character?

I just learned about Ghost Rider & immediately adored the look & concept of this character, until I fucking found out Marvel did exactly what i was thinking & just changed his name to Phantom Rider. Like bro, my universe was heavily associated with the multiverse in a different than what's been depicted nowadays & really had a good idea to put Ghost Rider (obv change the name) into my wild west universe until I saw Marvel's character. It honestly annoyed me. I don't know if i can still use the 1949 version & just only change the name. Researched a bit and saw there was a Haunted Horseman one-shot, but couldn't find images that showed if it was the same one or not. Idk if marvel made tweaks to his costume or something so i can stay away from it but man did that disappoint me heavy & really wanna know if i am able to use him still. I was also thinking of making him Chinese cuz i honestly didn't like the whole Sing Song sidekick kind of thing. idk if it is, but to me it seems a lil racial disrespectful? idk, correct me if im wrong.

All in all, can i use the same design & looks as the 1949 version even though Marvel also has the same iteration?

Would it be ok to write a fictional superhero story taking place during 9/11?

I saw a post on IG about how 90% of Marvel characters live in New York yet 9/11 happened and they didn't do anything about it, which could be a joke or something but made me think what if i had heroes be in the right place at the right time when it happened to save people from it? or alternatively, what if i wrote a world where it didn't happen? or also alternatively, what if there was a hero that was on a mission to prevent this, got on the plane, but end up failing? ultimately, i just don't know if its ok to write something like related or taken place in that tragic event & not disrespect people who experienced it or had loved ones that passed away during that event.
