Help! Our broker is not remitting rental fees of our tenants. Now they want their security deposit, what to do?

We hired a broker to facilitate the needs of our tenants, including showing the property to prospects, preparing contracts, and checking on the tenants’ needs from time to time. In return, he receives a commission, which he said is the standard one-month rental fee (for 1 year contract).

Everything had been going well for at least a year. However, this year, we noticed that there had been no remittances to our bank account. When we asked the broker about it, he admitted that he had used the funds personally. We also asked the tenants, and they said that the broker instructed them to give the payments directly to him in cash.

Now we are having difficulty collecting the funds, and the money that was supposed to be used for the HOA payments is already in his possession. On top of that, the tenant is already requesting the return of their security deposits.

We understand that this is ultimately our responsibility, and we also acknowledge our fault for not monitoring the payments more closely. We are prepared to assume all liabilities to the tenants.

However, we would like to know what legal actions we can take to hold the broker accountable. He is now MIA. Is there an office or governing body where incidents like this can be reported? Perhaps an agency that regulates brokers or agents?

Any kind advice would be highly appreciated. Thank you.

Just a question who provides fire extinguishers ? We are renting a condo and the owner says no fire extinguisher are provided sa unit namin kasi mura na ung rent namin?! Diba po strict compliance sa condos with or without tenant dapat may fire extinguisher?!

No visitors allowed 10pm onwards in a condo

I don’t know if this is normal but I was surprised when my cousin was not allowed to visit my condo when he entered past 11pm. The guard said visitors who enter beyond 10pm can only leave in the morning the next day.

We were supposed to go to pobla and he was gonna ride with me going there. We were supposed to pregame and leave around 12am. Good thing we were able to convince the guard to let him in cause we were gonna leave by 12am.

Is there visiting hours in condos? I laughed when I heard about this rule and thought it only applied to hospitals haha

Condo not allowing parcel deliveries.

May I ask if it's a norm for condos to not accept parcels on behalf of their unit owners?

We have just received a memo that the conceirge won't be allowing any deliveries handed to them starting next week.

Personally, it's such a headache and given that we're paying a hefty amount for assoc dues, isn't this a simple thing that they can do?

Is this really normal? Thank you!

Advice on choosing a condo

Hello! I would appreciate any advice for a first-time solo condo renter, since it will be my main home moving forward hehe

I will be moving to Ortigas for work but I am so undecided on which building/condo to choose. Net pay is around 70k and office is near Podium mall.

Here are my options:

Option 1 - 15k

Pros:

  • Affordable
  • Building has good reviews from tenants

Cons:

  • 18-20 min walk to work (might shoulder 2k monthly for angkas rides during mornings)
  • Bare unit

Option 2 - 23-25k

Pros:

  • 5 min walk to work
  • Spacious, 37sqm
  • Semi furnished/furnished

Cons:

  • Expensive
  • Not sure if I need such a big unit for myself

Option 3 - 18k

Pros:

  • Fully furnished
  • Still within budget

Cons:

  • 13-15 min walk to work (might shoulder 2k monthly for angkas rides during mornings)
  • Building and unit on the older side, not the most "maaliwalas"
  • All furniture made the unit seem smaller

I'd appreciate any insights or other condo recommendation. Thank you!

Hi, guys! I’ve been thinking heavily since I’m torn between apartment or condo. However, I have an infant so I decided to go for condo for added security.

The thing is, I’m currently tight on a budget since I’m recovering from giving birth and exhaustion of taking care of my newborn (ftm).
