The parties are requesting that the October 5, 2026 trial be continued to August 30, 2027.

The continuance applies to Durk Banks, Deandre Wilson, David Lindsey, and Asa Houston.

The government does not object to the requested delay.

Counts 1 and 6 were not part of Durk’s first trial and remain pending.

Count 1 charges VICAR murder under 18 U.S.C. § 1959(a)(1).

Count 6 involves alleged use/carry/discharge of firearms and a machine gun in furtherance of a crime of violence under 18 U.S.C. § 924(c).

Asa Houston has not yet gone to trial and still faces additional charges connected to the case.

Prosecutors estimate their case-in-chief at the upcoming trial would last approximately three weeks.

All four defendants are currently detained pending trial and Durk has a bond hearing on November 4th. Asa Houston may also ask for bond again.

The case contains hundreds of gigabytes of digital evidence and more than 30,000 pages of records and reports.

Evidence includes audio/video recordings, surveillance footage, digital-device extractions, photographs, witness statements, medical records, and reports involving alleged violent acts.

Durk’s attorneys state that they explained his Speedy Trial rights to him and that he voluntarily agreed to waive the right to be tried before August 30, 2027.

Wilson, Lindsey, and Houston also agreed to the Speedy Trial waiver through their attorneys.

Durk, Wilson, and Lindsey object to being jointly tried with Houston on issues involving charges on which they were already acquitted.

The filing preserves the defendants’ ability to later ask the judge for separate trials/severance.

August 30, 2027 is only the proposed new trial date at this stage. The judge must approve the continuance before the date officially changes.
