Without regard to what stands before me I will prevail
There is a contention between an attorney who has his solo practice in St. Charles County Missouri and his former client in a medical malpractice complaint who lives in a residential care facility in St. Francois County Missouri.
The contention began when the attorney into whose hands the former client deposited his trust betrayed the cause and complaint of his client when the attorney shared privileged information with opposing counsel during a mediated settlement agreement conference.
Then, four days later withdrew representation and left the law firm whereat he was employed. - The damage had now been done. - The privileged information was my case theory, valuation metrics, mock cross examination, counter arguments to opposing counsel, work product and the more intimate "state of mind" of the client.
Months later. the former client arose from the ashes and devastation into a new creation. No longer an unsophisticated plaintiff litigant but an advocate for the "juris-marginalized" who suffer from the imbalance in the attorney - client power dynamics when legal counsel employs their craft to their advantage and to the the hurt of their own client.
Disclaimer: The criticism is not toward the legal community as a whole. The multitude of attorneys, lawyers and law firms that provide value and render services are worth their weight in gold when they are called upon in a time of need.
Yea rather, the criticisms are with regard to those "bad actors" who engage in acts of misconduct and malfeasance to the hurt of their clients. - For those who practice law with integrity yet perhaps, may make "errors and omissions" while practicing law in good faith I bear no criticism.
The matter at hand is with Anthony R. Friedman now doing business as Friedman Law Firm in St. Charles who was formerly acting a lead counsel in the matter of Pepper v Gelfand M.D. while he was employed with The Simon Law Firm P.C. in St. Louis Missouri.
There are other "bad actors" who are yet employed with the Simon Law Firm who are the subject(s) of my criticisms as well and The Simon Law Firm and managing partner John G. Simon is vicariously liable for the misconduct and tortious acts of malfeasance as well.
With regard to the subject matter of this post, that is, Anthony R. Friedman, Albert B. Pepper Jr. acting as a consumer advocate and citizen journalist has written and published prolifically about the professional and business conduct of Friedman while he was employed with The Simon Law Firm P.C. Yet further, in his solo practice as the Friedman Law Firm LLC in St. Charles.
The investigation and expose has been quite devastating to the professional public facing persona of Friedman (every allegation having a basis in fact) and it reached a point where the public expose upon Friedmans conduct became for Friedman, prodigiously uncomfortable and untenable. - So what did Friedman do?
- Friedman filed a complaint with the St. Louis Metropolitan Police Department citing "harassment" and a fear for his personal safety. An attempt to use police power to "frighten" Pepper into silence. - The S.L.M.P.D. found no basis for charges.
- Friedman filed a complaint with the St. Charles County Police Department citing "harassment" and a fear for his personal safety. An attempt to use police power to "frighten" Pepper into silence. - The S.C.C.P.D. found no basis for charges.
- Friedman file a petition for an Ex Parte Order of Protection in the 11th Judicial Circuit Court on April 9, 2026 citing the same allegations of "harassment / stalking" and a fear for his personal safety. An attempt to use judicial authority to de-platform all of Pepper's social media and consumer advocacy tools to effect a "prior restraint" on constitutional protected freedom of speech. - A constitutional protected right both with regard to the constitution of the United States and that of the State of Missouri.
Note: The Missouri Senate recently passed SB 1067 with a unanimous 31-0 bipartisan vote, a bill designed to cure the exact type of retaliatory conduct Friedman employed. Having cleared the Senate, the bill moves to the House; upon final passage and the signature of the Governor, it is expected to become a statutory remedy on August 28, 2026."
Upon receipt of the Ex Parte Petition and summons to appear in Division 12 of the 11th Judicial Circuit of St. Charles County Pepper prepared and filed his Motion to Dismiss With Prejudice having substantial merit and affirmative defenses citing Model Rules of Professional Conduct, Missouri Statute, Case Authorities, Exhibits and Legal Maxims to be employed at the discretion of the trial court.
Both Anthony R. Friedman (Petitioner, attorney) and Albert B. Pepper Jr. (Respondent, litigant pro se) appeared on the morning of May 13, 2026 in Division 12 to present before the Hon. William Byrnes to hear the testimony, view the exhibits and deliberate upon the Petitioners claims for relief and the Respondents affirmative defenses.

Conclusion: Hon. William Byrnes granted the Respondents motion for dismissal with prejudice with prejudice acknowledging that certain elements in the Petitioners complaint were "plausible" but did not satisfy the statutory threshold for a full order of protection. The petition was dissolved and the Judge proceeded to lightly admonish the Respondent for his conduct moving forward. An admonishment that I the Respondent do well to take heed. It was a very sophisticated, even handed adjudication of the matter.
With the Motion to Dismiss with Prejudice the subject and prior conduct is now moot.
Now that the matter is moot I make this declaration (of which the named parties previous have not known).
I am in great admiration of Judge Deborah Alessi, Judge William Byrnes and that of Senate candidate Mrs. Tricia Byrnes and of Judge Mike Carter. I am extremely fond of Senator Nick Schroer, a warrior and champion for the unborn and that of Gov. Mike Parsons and of Lieutenant Gov. Mike Kehoe.
With regard to the "Venerable" Robert H. Dierker Jr. formerly of the 21st. Judicial Circuit (who also was a controversial figure, yet no would could deny his deep, scholarly treatment with regard to the intersection of progressivism and jurisprudence) it may seem a little "quirky" that this "lowly shepherd boy" when he grows up wants to be just like him. 🤗
