I posted a running list of reportedly impaired Delaware Statutory Trusts in August. Here is the October update.

Important: “New additions” below means newly added to this list since the August post. It does not necessarily mean the problem first arose during the last two months. Some of these issues began earlier but were identified or better documented after the prior post.

I am using “impaired” broadly to include reported bankruptcies, foreclosures, mortgage defaults, receiverships, suspended distributions, capital calls associated with financial distress, distressed dispositions, and other material events that could affect DST investors.

NEW ADDITIONS SINCE THE AUGUST LIST

NB Flats, DST — Filed Chapter 11 in April 2024 and was converted to Chapter 7 liquidation in February 2025. The bankruptcy case remains open.

The Nine (Memphis), DST — Reported foreclosure/receivership involving the senior mortgage.

Tailor Lofts, DST — Reported loan-payment delinquencies and lender-watchlist issues. Public reporting in 2026 indicated investors may not receive distributions during 2026. Distributions had also previously been suspended during the COVID period.

Shadowglen, DST — Investors reported a mortgage default and capital call in August 2026.

345 Flats, DST — Reported suspension of investor distributions.

Astoria, DST — Reported suspension of investor distributions.

AW Newport, DST — Reported suspension of investor distributions.

CP Cincy, DST — Reported suspension of investor distributions.

Inspire on 22nd, DST — Reported suspension of investor distributions.

Oakbrook, DST — Reported suspension of investor distributions.

Wolf Run, DST — Reported suspension of investor distributions.

4ANDJ / 4th & J, DST — Reported senior-mortgage delinquency, along with subsequent investor reports concerning limited financial information and discussions involving a possible sale or 721/UPREIT transaction.

Reader-reported item I am still trying to independently verify

KB Parkshore, DST — An investor responding to the August list reported that distributions had not been paid for more than three years. I have confirmed the DST and underlying Parkshore Plaza property, but I have not yet located sufficient independent documentation confirming the reported distribution history. If anyone has investor communications or another public source, please post it.

MAJOR STATUS CHANGE SINCE AUGUST

Hayworth Tanglewood, DST was previously included based on suspended distributions and other distress. The situation has since escalated substantially. The property is now subject to foreclosure litigation and a court-controlled receivership, with a receiver exercising operational control over the property.

This remains a running research list, not a determination that every investment has suffered a permanent loss. The severity and nature of the issues vary substantially. Some events are historical, some may have been resolved, and a suspended distribution by itself does not necessarily mean that investors will lose principal.

I am also trying to distinguish between matters supported by court records, bankruptcy filings, SEC filings, lender information or other documentary sources and matters that are currently based primarily on investor reports.
