I took my kid to the playground today and this guy was “exercising” there. I was observing this guy as he took turns rubbing himself on different poles on the playground. I find this disturbing and uncomfortable especially around children for obvious reasons. You never know the intent of some people.

They have other elderly adults exercising near the playground area, but not on the playground slides. I don’t think adults should be hanging out in the immediate playground area if they aren’t supervising their own child/grandchild playing. Or if you’re there, don’t be weird.

I approached him and told him this is inappropriate behavior especially on a playground full of children. He didn’t speak English so I tried my best with hand gestures. I told him if he didn’t leave I would be calling the police. He dismissed me saying “Chinese” and when to another area of the playground and continued “exercising”. Nobody in the vicinity seemed to be concerned.

Hi, I got pulled over and ticketed in my Tesla while it was self driving. The officer claims he saw me using my cell phone, but I wasn’t. I may have been using the mounted touchscreen, which isn’t a portable electronic device.

Do I have a dismissible case based on technicality? Anyone have experience in this court? Should I get a local traffic attorney or try to do it myself? How likely will this get reduced to a no point ticket?

Ticket: “Operate Moving Motor Vehicle While Using Portable Electronic Device (1225D01)”

Supporting deposition: 7. “Charge Based on Officer's: Direct Observation”.

  1. Additional Information: VEHICLE WB ON TROY SCHENECTADY RD RIGHT LANE I OBSERVED OP WITH CELL PHONE IN RIGHT HAND TOUCHING THE SCREEN. OP SAID HIS VEHICLE WAS IN SELF DRIVING MODE AND THAT HIS WIFE MAY HAVE HAD PHONE IN HAND WHEN IT CLEARY WAS IN HIS HAND.

Court: Colonie Town Court Latham, NY (Albany County)

This is my first cell phone ticket. But I did receive a 6 point speeding ticket that was ultimately reduced to 2 points, failure to obey traffic control device in Austerlitz court in 2024.
