Child Support Modification - Im lost. (FL/GA - AL)
Originally when my son's biodad was placed on child support the order was initiated and processed through the state of FL in 2021. Due to him residing in GA I was told it was an "interstate" case / order which then also resulted in GA ultimately deciding the final order as well as removing owed back financial support as it took 3 years to get an order. (If I understood correctly). Over recent years there have been multiple instances and periods of non-payment and any time I tried to pursue or follow up regarding the concern I always ended up in chasing my tail in a circle between with the two states with no resolution. There has been one action taken by child support enforcement 2 years ago retrieving back pay from income taxes.
I now currently live in Alabama and as far as I am aware he still lives in Georgia though he has not had any true contact with the exception of 3 text messages with me in over 4 years. He has not seen nor had contact with my son since he was just under 2 years old - hes currently 8. I never pushed the issued and just used the $375 monthly order for child care.
I am now currently trying to figure out what I should do or options to submit a modification due to not only the economy etc - but also because currently he is not paying at all. I do have knowledge that he has since remarried, has been on SS / Disability / Medical Military Retirement and still working (he was receiving all of those when the original order was put in place). While I am still a single income home and responsible for 100% of all my son's needs etc.
There was never a custody agreement or order placed as he has maintained zero presence in my son's life nor attempted. While I know that doesn't make me the legal sole custodian- thats not an issue I believe he cares to fight or make an issue. The financial side on the other hand he has no agreed about from the start. My son was born in 2017, case was started in 2019 due to covid never finalized till 2021 - no modifications have been made or attempted since.
I dont know how to file for this who to go to in order to pursue non-payment. Or even where to start. Any suggestions would be appreciated.
