The court will hold a hearing on the government’s emergency motion to stay the June 5 vacatur order pending appeal.

Chief Judge John J McConnell Jr has granted summary judgment in favor of plaintiffs in Dorcas International Institute of Rhode Island v. United States Citizenship and Immigration Services(1:26-cv-00132) and has vacated multiple recent USCIS memos as unlawful.

The deadlines to join the lawsuits are approaching quickly. Today is the final day to join Hacking’s second round, and the deadline to join Red Eagle Law’s class action lawsuit is May 14.
At this point, the lawsuits have proven to be the most effective way to challenge the pause, so if you are able to join one, it is strongly recommended. We likely will not see additional lawsuits filed for some time, as most law firms are expected to wait for further developments and results from the current cases.
