I was rear ended at a red light back on 3/21. I filed a claim with his insurance and have been going back and forth with them once a week ever since. Each time I’ve called they’ve stated they have 35 business days to complete their investigation and this last Friday the agent stated they hadn’t been able to get in contact with their insured so she would be escalating to her manager.

I was reading about duty to cooperate and am now wondering if his insurance can deny my claim because he hasn’t picked up their calls. Is this a thing and if so is there anything else I can do?
