Am i eligible ?
Hi everyone,
I am trying to determine my eligibility for German citizenship (potentially via Art. 5 StAG or Feststellung). Here is my family timeline with all the documentation I currently hold:
Great-grandfather (Andreas Stowasser): Born on October 29, 1910, in Maria Kulm (Chlum Svaté Máří, Sudetenland). Ethnically German (Volksdeutsche). He automatically acquired German citizenship via the 1938 collective naturalization decree.
Grandmother (Ingeborg Stowasser): Born on July 25, 1940, in Liebenstein (Libá, Sudetenland). She was a German citizen by descent from birth.
1961 (Thiersheim, Germany): I have an Aufenthaltsbescheinigung from Thiersheim dated November 6, 1961, explicitly stating her Staatsangehörigkeit as "deutsch".
1961 (Marriage & Swiss Citizenship): On November 25, 1961, she married a Swiss citizen in Switzerland. Her Swiss Heimatschein was issued on December 26, 1961.
Note on Swiss Law: I have a formal written confirmation from the Swiss Embassy stating that under the 1952 Swiss Citizenship Act (Art. 3), she acquired Swiss citizenship automatically by operation of law through marriage, without any voluntary application or consent required. Therefore, she did not lose her German citizenship upon marriage.
1964/1966 (Morocco): She moved to Morocco in 1964 and had my father in 1966 with her second husband (Moroccan).
Myself: Born in Morocco, tracking my lineage through my father.
Documents I currently have in hand:
Czech-issued Rodný List (Birth Certificate) for my grandmother, listing her parents (Andreas & Katharina) and their birth dates/places (1910 and 1916).
The 1961 German Aufenthaltsbescheinigung (certified copy with a German Embassy stamp from 2012) stating she was German.
Swiss Familienbüchlein (Family Book) showing the 1961 marriage and listing her previous nationality as German.
Old Swiss Passport from 1963 showing the December 1961 Heimatschein date.
The official email confirmation from the Swiss Embassy in Vancouver validating the automatic nature of her Swiss naturalization.
