Hello.

I am currently in the offer stage with an RPO Company. May candidate form na pina-fillout sa akin and one of the questions was about whether I signed a non-compete in my previous job to which answered “Yes”.

I received a follow up e-mail yesterday and nakasulat na I should take the necessary steps to make sure na I am not breaching this agreement and that it will not affect my employment with them. So now I am kind of confused and very nervous na I might lose the opportunity.

For context, I previously worked as an entry-level Talent Acquisition Associate sa isang BPO Company and I resigned in March and I have been out of a job ever since. Doon sa non compete agreement, it is indicated that I cannot work in a BPO company located in the same jurisdiction as their office and services the same clients for at least 1 year from resignation.

Is the non compete enforceable in this case? I am really afraid on losing out on this opportunity especially since I am in the offer stage already and ilang months na rin ako naghahanap ng work. They are still finalizing the contract itself so I have not signed anything but we already had a verbal agreement pero natatakot ako na baka bawiin.

I received a Job Offer last week and I was supposed to start this Monday but I asked if it can be moved because I still had requirements that I had to process. The recruiter told me na she’ll raise it to the hiring manager and that she’ll let me know right away. Pinasa ko naman na yung mga requirements na meron na ako and told them to follow na lng yung iba. The last update that I got was last Monday and sinabi sa akin that my request for a new start date was granted pero pending pa yung exact date. I acknowledged the email and asked for a follow up nung Tuesday and Thursday. Still no response. Kahit dun sa additional questions ko and my request for the PEME slip wala ring reply.

I’m starting to worry kasi I stopped applying altogether kasi akala ko secured na. If di pa rin nag reply today, should I consider myself ghosted and keep applying?
