Ich wurde gekündigt
Hi! Ich brauch mal euren Ratschlag.
Kuez zu mir: W24/IT-Sektor aus Österreich, noch keinen Tag Arbeitslos gewesen, seitdem ich 15 bin.
Ich war 4,5 Jahre bei meinem Arbeitgeber beschäftigt. Meine Position wurde jetzt in Zeiten von KI & Ausbeutung in 3.-Welt Ländern nach Indien verschoben. Ich wurde auch mit heute freigestellt.
Steige ich hierbei gut aus? Auf was muss ich achten? Wie läuft das mit dem AMS? Hab ich trotz der Abfertigung Anspruch auf Arbeitslosengeld?
Ich kann hier leider kein bild vom Dokument reinposten, daher als Fliestext (internatinales unternehmen, daher auf Englisch. Sitz aber in AT):
Mutual Agreement
The Company and the Employee mutually agree to terminate the employment agreement of the employee effective October 31st, 2026 (,,End Date").
Effective October 9th, 2026, the Employee shall be irrevocably released from the obligation to perform work duties until the agreed End Date ("Garden Leave"). During the Garden Leave period. he employment relationship shall continue unchanged, and the Employee shall remain entitled t receive their full contractual remuneration and benefits in accordance with the terms of the employment agreement. The Employer may require the Employee to remain reasonably available to provide information and assistance in connection with an orderly handover of duties. The Employee shall continue to observe all contractual duties, including duties of confidentiality and loyalty, until the End Date.
The outstanding vacation balance of 7 not consumed vacation days as of End Date will be paid out as vacation compensation in the final payroll.
The pro rata special payments ("Sonderzahlungen") will be settled and transferred to the Employee's bank account with the final payroll, no later than October 2026. Outstanding travel expenses will also be reimbursed at that time to the Employee's bank account. The Employee receives a Certificate of service on the End Date.
The employer shall pay the employee plus hours from the time account with 50% supplement to the mentioned deadline.
Additionally, the employer pays a voluntary one-time severance of gross 14 382,48 EUR to the employee, subject to taxation.
The final settlement and handover of all documents will take place after the Employee has properly handed over their workplace and work area, as soon as possible after receipt of the payroll accounting.
Proper handover includes the return of all items in the Employee's possession (e.g., laptop, keys, access chip, cell phone, etc.) to the Company on the last working day.
Subject to the correct settlement of points 1 to 5 of this mutual agreement, the Employee and the Company confirm with their signature that there are no further mutual claims of any kind and any future claims, known or unknown, are hereby settled in full.
