Birthday Gift delayed by a week

TLDR :

Ordered a Celestron Powerseeker telescope from Amazon on 2nd May as a birthday gift for my little sister, with delivery promised for 9th May. The package shipped on 4th May but tracking stopped updating. Over the next week, I contacted customer support multiple times and received only vague responses like “delayed in transit” and “operational delay.” I was even asked to reschedule the delivery so they could supposedly prioritise it, but nothing changed. A senior executive promised a follow-up and resolution by 16th May, but neither happened. Amazon has now agreed to refund the amount, but the repeated delays, poor communication, broken assurances, and inconvenience caused significant frustration and spoiled the purpose of the purchase.

Recently I ordered a telescope (Celestron Powerseeker) from amazon. The order was placed on 2nd May and was shown a delivery date of 9th May.

The birthday was on 6th , but even then since the product was good we thought we could wait.

On 4th the package was shipped from Uttarpradesh and there were no updates from their side.

On 9th ( due delivery date) , I contacted them enquiring about the order. They mentioned that it is due in transit and running late. ( I have the call recordings) .

Till then there were no updates shown in the app but after the call the same was being reflected.

I thought, it's fine I can wait for two more days since we didn't know how we could get this item offline from our home town.

On 12th I again reached out asking the same , they mentioned it's still delayed and failed to provide me a conclusive reason as to why it is delayed . In the app it showed the final delivery location as chennai.

On 13th , I contacted and they mentioned that if I were to reschedule the delivery , then the customer executive team could give an update to logistics team and make the shipment out for delivery from the hub. ( Even though in app it is showing package in Chennai ) .

I agreed to that thinking atleast now they will prioritise the order.

All the email confirmations they gave till then were the same information that was present in the app.

On 15th morning, I called them again enquiring why the package was delayed and why there are no updates from their side even after rescheduling.

I was given vague responses , circling back to the same thing as to , ' delayed in transit ' .

I finally managed to redirect the call to a senior executive when I reached then again the same day evening.

He mentioned there might be some operational delay and logistics delay , delay in the route taken something like that and said the buffer period for the order is 16th May 10 PM. ( 7 days after original delivery date ) . He assured he will give me a followup call ( since I was explaining the issue again and again to different executives ) by 16th 10PM regarding the order delivery details.

However I did not receive any calls as of such nor did I receive the package.

I no longer want the product. They have agreed to refund the whole product amount but I am not sure whether that would suffice the mental inconvenience I had gone through. ( This was a gift to my little sister).

Is there any way I could move through consumer court and make them pay for their negligence and repeated delays
