I have seen multiple posts lately about a new trend from apartment complexes and HOAs wherein they obtain DNA samples of all pets so that when dog poop is found left outside, it can be collected and tested and the appropriate owner fined. I am not asking about the legality of this practice.
Are there any cases where a resistance was charged a fine for this and went to court to challenge and won? Did their defense revolve around an alibi for their dog or were there chain of custody issues for the dog poop?
I am in Tennessee, but interested in all states. This is not an issue i am having, i am just asking about previous cases.
