FL At Fault Accident
So I was in an accident, did not see the person and their car got side swiped. There were no injuries at the time and only minor damage so it was a driver's exchange.
My insurance has deemed me at fault, now the other driver is claiming they are injured in which the wreck was not major enough to cause injuries, not even enough to case whiplash, and definitely not enough to exceed the states minimum and their PIP.
The other driver did also refuse to go through their own insurance and then get reimbursed by my insurance when it came to any car damage. I am not sure if the other driver is mad because they wanted my insurance to pay out right then and there and provide a rental and they had to wait but now they are trying to find a lawyer. My insurance also told me that FL is a no fault state with injuries and they would have to go through their insurance for 80% and my insurance said they would cover the other 20%.
I am not sure if the other driver wants to sue me or not, or just wants a lawyer because they are simply confused about how the process works. I also dont think the person has contacted their insurance for PIP and came directly to mine to file a claim for injuries.
But I was always told to file a claim with your own insurance. The insurance companies conduct a liability investigation then communicate and then at fault insurance will then pay out.
Does anyone have experience in Florida with this?
