CGA, who decides what constitutes a major fault and who is able to choose the remedy?
Bought a Samsung A16 from a big box retailer and the phone stopped charging after a couple of months use.
It also has an absolutely diabolical camera, the combination of no OIS and a laggy interface means that it's a dice roll if you'll get a usable photo out of it or not.
I hadn't looked at or had to deal with the CGA for a long time but the retailer was insisting that they had the right to fix it and it was their choice if they fixed it/replaced it and that that would depend on what issue Samsung's repair centre found.
With the camera being abysmal i'd prefer to exchange it for a different model or get a refund.
Looking over the CGA the wording isn't super specific as to what constitutes a major fault. I'd argue that a phone that doesn't charge would fit the bill, and that maybe I could make a case that the camera isn't fit for purpose but the store was saying things like "well if its just the port it's a minor fault and we'll fix it etc etc" and "you had the opportunity to test the camera in store.." I bought it online and no reviews mentioned the laggy camera app and resulting blurry photos.. but anyway.. All they're saying here is that if its costly to fix, ie a motherboard issue, they'll replace it, but if it's the daughter board or port etc they'll fix it and I don't have a choice.
Would I be correct in thinking that a phone that doesn't charge is a major issue and the choice is mine as to the solution?
