In a 5-4 decision, Supreme Court dismisses Hamm v. Smith as improvidently granted. Justice Alito dissents joined by Justice Thomas and partly joined by Chief Justice Roberts and Justice Gorsuch. This is a victory for Smith whose death penalty was vacated by a federal district court.

In a unanimous decision, the Supreme Court rules that the statute governing the selection and use of actuarial assumptions in the withdrawal-liability context contains no requirement that actuaries use assumptions adopted prior to the measurement date.
