This happened in Suffolk County NY. West Babylon specifically.
I am wondering if I should get a lawyer and start a 1983 lawsuit. Here are the facts as I see them:
• The temperature outside was 81 degrees.
• I had my dog with me.
• I exited my vehicle for exactly 6 minutes to cash 2 checks in the bank. My dog remained in the vehicle.
• I had ONE window left open about 6 inches.
• I left ONE window open
• As I was walking out of the bank... an elderly woman (70s) was walking in and screaming that she is a detective working for animal crimes. I inform her its my truck and I'm going. I apologize and keep walking out.
• I get to my parked truck and she is still screaming
• Police arrive within seconds.
• Cop "detains" me claiming "Level 3 Terry Stop" because hes investigating animal cruelty. He tries to open my truck door to see my dog and I tell him I dont consent to searches but will happily grab the dog for him to check her out. He says hes in charge.
• He moves me out of the way and opens my door. Dog jumps to passenger side to evade him. He goes around opens other door and grabs dog.
• He clears dog... verbally states that the dog is not distressed and that the dog is perfectly cool and well.
• I ask if I'm free or detained and he keeps me detained. 45 minutes... I ask 20 times if I'm free and what he is detaining me for. He keeps saying animal cruelty. He keeps asking for my side of the story and I keep saying I have nothing to say.
• after investigating my dog and clearing her... detaining me for 40 more minutes is a violation of my rights correct? Especially since I asked continually asked and stated that I want to be free to leave.
