Legal Defensibility of Mob Euphemisms

I was recently re-watching Live Free or Die, where Tony orders the hit on Rusty. Its the scene where he talks about how we're gonna "fit him for a suit" and "our friend is sending over some of her best tailors".

Obviously the point of talking like this (other than making interesting dialogue) is to protect himself if somehow the feds have a on a mic. This made me wonder; would it actually protect him?

If the feds heard this conversation, and a few days later Rusty was killed, and eventually that audio was played in court (especially accompanied by Chris saying Rusty's name in that conversation, and possibly even them catching the hitmen and them being two Italians like Tony hinted at), would his vagueness protect him legally at all? or would he be just as screwed as if he plainly said "we're going to kill Rusty"
