Had anyone dealt with a conflict of interest involving an elderly incapacitated parents attorney?
Florida
I’m curious if anyone has been through something similar involving elder law/probate and attorney ethics.
My father passed away, and since then there has been a lot of conflict involving my mother’s care, finances, and power of attorney. My sister originally had her own attorney, while my mother had a separate attorney representing her interests.
Then all of a sudden, my sister stopped using her own attorney and kept my mother’s attorney on instead — meaning my mother’s money continues paying the attorney while he appears to be defending and protecting my sister’s position. I became increasingly uncomfortable with the lack of transparency surrounding financial records and communication.
My own attorney told me she believed the situation was ethically concerning and suggested I file a complaint with the Florida Bar so the representation could be independently reviewed.
I filed a complaint with the Florida Bar, and they opened an inquiry and required the attorney to respond. He has now hired separate counsel to defend himself in the complaint process, which honestly feels intimidating as a non-lawyer.
I’m not looking for revenge or trying to hurt anyone. I genuinely just want fairness and independent oversight because the situation feels wrong to me.
Has anyone else gone through something like this? What was the outcome, and did you feel the Bar process was worthwhile?
