PTO and PFMLA (Massachusetts)
[LOCATION: Massachusetts] So I have a baby on the way. I'm applying for PFMLA in Massachusetts. I want to use my PTO bank to top off my paycheck (as mandated by the state) but my employer said they need to "keep it consistent for everyone's leave" and that I can't/shouldn't do that, and should instead cash out my PTO and use it to top off my PFMLA checks that way.
Is this legal for my employer to do?
If I were to cash out my PTO, are there penalties that would occur? I looked up this exact question on Google but based on what I'm seeing, if I cash out my PTO, my approved PFMLA checks would be $0 to ensure that I'm not receiving more than my IAWW at any given point
I do really like my employer. How can I stand up for myself without being disrespectful? I think it's less malicious and more so a lack of understanding of MA law
I've just been so stressed about this whole thing. I am so confused as to what penalties there are if I cash out, and I'm worried that my PTO will be mishandled if I don't. Can someone help?
