EB-2 NIW for Construction Management / Project Executive — Honest Case Feedback Needed

I’m preparing a self-petitioned EB-2 NIW case in the construction/project management field and would really appreciate feedback from people who have gone through NIW, worked with attorneys, or understand how USCIS evaluates these cases.

Background:

  • Civil engineering / construction management professional
  • ~11+ years total experience
  • About 9+ years in senior project management and executive leadership
  • International experience managing large residential and mixed-use developments in the Middle East
  • Progressed from Project Manager to General Manager
  • Oversaw multiple concurrent projects and large workforce operations (hundreds of workers including subcontractors)
  • Experience includes luxury residential, high-rise, mixed-use, hospitality, and infrastructure-related projects
  • Currently in the U.S. on F-1 status pursuing a STEM Master’s degree in Engineering Management
  • already have an Equivalency Report from IERF saying: "has the U.S. equivalent o f the Bachelor o f Science in Civil Engineering and nineteen semester units of graduate coursework."
  • Recently formed (very new) a U.S.-based construction management & consulting company focused on owner’s representation, project management, development consulting, and construction oversight

My proposed endeavor is centered around:

  • Construction management leadership
  • Improving project execution efficiency
  • Supporting residential and infrastructure development
  • Bringing international project delivery experience into the U.S. market
  • Future plans involving development, rehabilitation, and construction consulting

What I currently have in my petition package:

  • Employment verification letters
  • Organizational charts
  • Detailed project portfolio
  • Recommendation letters from colleagues, clients, and industry professionals
  • Media coverage and project recognition
  • Evidence of leadership responsibilities
  • Evidence of managing large manpower operations
  • Business formation documents
  • Website and business presence
  • STEM graduate enrollment documentation
  • One technical conference paper presentation from years ago (not highly cited)

My concerns:

  1. My U.S. company is very new and does not yet have contracts/revenue.
  2. Most of my strongest experience is international, not U.S.-based.
  3. I don’t have major publications, patents, or national awards.
  4. Some evidence (like payroll/manpower records from old projects) is difficult to obtain because I no longer work for the company overseas.
  5. Recommendation letters are strong, but many are from former colleagues rather than famous industry figures.

Questions:

  • Does this sound realistically approvable for EB-2 NIW?
  • What would USCIS most likely challenge in a case like this?
  • Is the “well positioned” prong usually the hardest for construction management cases?
  • How important is proving future U.S. economic impact when the company is still in startup phase?
  • Would premium processing be risky in a case like this?
  • Has anyone here been approved in construction/project management without publications/patents?
  • What kind of evidence made the biggest difference in your case?

I’m looking for honest feedback — including critical feedback — from people familiar with NIW standards or similar professional-background cases.
