ESTA from Netherlands

hello,

I am looking to renew my ESTA as my current one expires in one month. Since my last visit to the USA I have been accused of possessing harddrugs under Dutch law. This is a felony
that is handled via a fine. I fought this and the case was eventually dismissed on grounds of it being too long ago. In Dutch law this is called a ’sepotbeslissing’ and is neither a conviction nor an acquittal. Because the grounds for dismissal are the case being too old it has been put on my criminal record as per Dutch law.

However:

  1. ⁠I have not admitted to anything
  2. ⁠I have not been convicted or found guilty: there was no penalty at all

Does this constitute a violation of drugs law for the ESTA question and do I answer yes or no? I am aware that answering yes denies me entry.

Also, if I do get an ESTA (which i probably will if I answer no), and I get a second interview at the border are they able to see this dismissal in my record if they contact Dutch authorities? Thereby denying me via that route?
