Would this be considered our fault or neighbors?

Hi all. I’m asking a genuine question- because I not only want to do this the ethical way, but also the legal way. I own this property, but I don’t live in this unit(duplex, I live in the front). The branch fell during our last windy day about a week ago. I’m in CA. Attached is photos of the fence line and the branch. It’s a protected cypress so I need a permit to do anything drastic to it. I also can’t really afford to do much other than get this damage cleaned up(can’t afford the pruning).

The zucchini I pulled today

Half of it will probably need to be used in zucchini bread. The other half will get cooked for dinner. My zucchinis have been on steroids since I moved here(Monterey CA).
