Lawsuit

LONG POST ALERT. I've been driving with Amazon Flex for about 2 months now and they can be VERY UNFAIR. I had an Amazon .com block that was a two hour block or two and a half hour block and it had like 20 or 24 packages which seems about right for a around 2 hours. So I loaded the packages in and got to work. As I got to like stop number 20, I noticed on my itinerary that I had like 18 more stops but only 4 more packages. I thought I had lost them at first but after checking my truck up and down and all around. I couldn't find the rest. So I called useless Amazon support and the first agent said since I had missing packages to just let the block time end itself and to finish the rest and go home. First off Amazon is going to wonder why I'm still on this route 3 hours after the block time ended. But the other agent said they would just mark the rest of the packages as missing and that I should not be penalized for it because they would check with the warehouse and confirm. Well it seems to me somebody is lying because sure enough i got a terms of service violation. I appealed multiple times and they refuse to remove it. I had to work myself out of the whole they put me in all because the warehouse didn't do their job and put the packages on the cart. Now I know some of y'all are going to say " Oh well you should've checked and made sure you have all the packages. Fair enough but at least for me they don't have it required to only scan all the packages to make sure you have them. I can also scan the bag and it'll scan all the packages for me. But I know now not to trust that the warehouse will do that job. That block hours was wrong anyway because 38 to 40 packages is not two hours. That's at least 4 hours, 3 if everything goes smoothly. But aside from that I had a whole foods order that had 1 bag missing. I called support and they transfered me to the live orders team. The agent mark my entire route as missing because she claim i did not say I only had 1 package missing. I even told the previous agent. She had the most nastiest attitude and almost told her well if you had not have such nasty attitude for whatever reason you would've heard me say I had 16 out of 17 bags and I had 1 missing. Anyway she said that she would document everything and that I would NOT be penalized for it. Well what do you know they penalized me for it on terms of service. Dropped my standing down from great to at risk. I emailed and called about it and they sent me an email stating that it was beyond my control and that they would remove it. Its been nearly two weeks and it's still there I've called about it they just keep saying that they will forwarded and that support will get back to me. They even kept trying to appeal it. I said we shouldn't have to appeal it because they said they would remove it. Anyway I'm fed up because this is the second time I got a terms of service violation for something that WAS NOT my fault and I'm think of taking them to court and possibly get compensated because if you didn't know and people will disagree with this. Your standing does affect your offers and I'm sure I've miss plenty of offers I'm sure because my standing is stuck on At Risk. They are probably trying to make me work it off like I did the first one but I'm over that and I'm thinking of getting an attorney. They sent me and email today stating that their original decision has changed and that my standing will stay at risk. One of the agent on the phone confirmed that my standing was not at risk but this email said it was. But I'm gonna record the next phone call I have with them about this and I'm gonna gather all evidence and probably take them to court. That violation is inaccurate anyway because it said I didn't pick up 4 packages. There was no block I did that I did not pick up 4 packages and I even called support and ask them was that violation related to that whole foods order and she said that it was because it was from a block 5:30 to 7:30. Anyway sorry about the long post but what do yall think? Should I challenge this? I'm sure they will deactivate me if I do but I got proof saying that they will remove it and they claim they won't. And I think one of the agents said that email was a mistake well too bad. Don't lie like that.

So I've seen people on here say that Amazon Flex doesn't give them overtime pay when asked for it and some people say that they have received it with no issues and was even compensated fairly. I've started about a little over a month ago and I've had delays and soo many packages at times and hold ups like no access to the apartments no gate codes traffic. So each block that took me over my block time I ask for overtime pay and they gave it and even payed fairly and I think total it was about 7 or 8 times I've asked for it and each time they paid me. But people been saying asking for too much overtime can rejected or even worse deactivated after about 3 times. I don't ask after every single block just only when I had unexpected problems and it caused me to exceed my block time and I've had routes that were smooth and some that just took wayyy too long. But I'm still activated and has asked for overtime multiple times. I could see them deactivating you if after every block you're asking for overtime pay. But at times unexpected things do happen and you should be compensated fairly with no penalty.
