CA Break Laws - changing time card
Hey all,
So I recently started this part-time, retail job at a college. My typical shifts are 8.5 hrs (8 working hours considering lunch), so my understanding is I am allowed two 10 minute breaks. I’m always given a lunch, it’s scheduled and always verbally reminded by managers to take. For weeks, myself (and coworkers) have only been given a lunch, no 10 minute breaks at all. Even for 6 hour shifts, only a lunch no breaks. Because the store’s fairly new, the team is small and a lot of times we are stuck at the task we are at alone for hours - so even asking to use the restroom has been hard at times.
Anyways, upon clocking out on ADP it asks if we’ve been given a lunch (I say yes), and it asks if we’ve been given rest periods in accordance to the law and there have been multiple times I marked “No”. ADP has automatically shown the penalty hrs but after looking at the most recent timecard approval, my timecard was changed to no penalty hours by a manager with a reason note saying “answered question incorrectly.” My manager’s never asked me about it, but she told me yesterday to not mark no anymore because they “have to pay a penalty”.
I don’t plan on staying forever, but I feel like if I’m owed for my time, I should be paid for it. Not sure what my options are at this point. TIA
