DWI refusal outcomes
I was stopped at the gate driving drunk passengers home the other day and was failed on field sobriety despite having medical and environmental factors that impacted the test. I refused breathalyzer because I wasn’t able to get any legal advice and they had to air out the breathalyzer room for it having incorrect readings.
After that I was released same day and given the 1 year driving and my car can’t be on base restriction. Then I found out a refusal is viewed as “admission of guilt”
The PMO report isn’t back yet but my command said they most likely will write up NJP.
I’m currently in a training status and want to know if there’s any possibility that a NJP won’t happen or if I’d be able to avoid losing rank/pay?
