Our 2019 Subaru Forester had only 60k miles on it when it suddenly died driving down the road. We limped to the local dealer where they found oil in the coolant system. The mentioned o rings or head gasket issue. They also noted that the TCV had failed.

They told us to call the Subaru consumer advocate service. After several weeks they offered to pay for parts, but no labor, for the complete rebuild of the engine. Their reason for this offer, we couldn't prove that we had changed our oil on a regular basis. I told them I only kept receipts for 1-2 years, which I provided, and the Subaru dealer had all the work completed during the warranty.

They claim that for a period of 29k miles we did not change our oil which caused the engine to fail. I argued that no motor could survive 29k miles without an oil change and that not having receipts does not mean we did not do the oil changes.

We had the car in the Subaru dealer last year, twice, and other a loose wiring harness the car and a problem with the battery dying (the engine shutoff device), the car passed all tests. There was no oil/coolant mixing and the TCV was still working.

We are thinking about appealing the offer and if needed going to arbitration.

Any thoughts or feedback on this situation would be appreciated.
