I filed a Form 1 (Notice to Resolve) because I reside in an Early Resolution jurisdiction. My application relates to parenting arrangements, specifically a request for increased parenting time, as I have concerns regarding the level of care my child is receiving while with the other parent. We currently share parenting time equally.
I filed and served the Form 1 on my coparent two days ago. I am scheduled to attend a mediation/early resolution meeting in two weeks before any further court steps can proceed.
Today, I received an email from my coparent’s lawyer requesting that I explain why I filed the Form 1, including the legal grounds or authority for doing so, and asking that I respond by Monday.
My question is whether I am legally obligated to provide that information at this stage? Additionally, does my coparent also need to schedule and attend the mediation/early resolution appointment as part of this process? Can their lawyer just… go in place of them?
