Concurrent I-140/I-485 filing with dependents – one package or separate filings?
I’m preparing a self-petitioned EB-2 NIW filing and would like to make sure I understand the logistics of concurrent filing correctly.
My plan is to file:
- Form I-140 with the NIW petition and exhibits
- Form I-907 for PP
- Form I-485 for myself
- Form I-485s for my spouse and children as derivatives
- Form I-765 employment authorization applications for myself and spouse
Assuming my category is current and I am eligible for concurrent filing, do all of these forms go together in one physical mailing package to USCIS, eg in separate clearly labeled sub-packets for the I-140 and each family member’s I-485/I-765? Or is the I-140 supposed to be filed separately first, with the I-485 packages submitted only afterward?
For those who have filed EB-2 NIW concurrently with family derivatives, how did you structure the package?
