Employment law advice
I’ve been employed for 10 years with a large company, for 7 of those years, I’ve been a retail manager. I have recently taken sick leave from work due to the stress and toxicity. They have requested more medical information, which I expected, however, the statement in one of the paragraphs leaves me wondering if my boss is going to retaliate by changing everything about my job if I were to require any accommodations. He owns another store location that is smaller in volume. The location is a few mins closer to where I live even, so it seems to me he might send me there and say this is what my accommodation is (to run a smaller department) which will significantly change compensation because commissions won’t be as high. The statement reads
“Please note that the Company is committed to meeting its duty to accommodate to the point of
undue hardship. In order to do so, we require sufficient medical information outlining functional
abilities and restrictions. Accommodation is based on medically supported limitations and is not
provided for personal preferences such as specific roles, schedules, or work locations.”
Because my boss is toxic, to me it translates as “don’t expect to come back to the job as you know it”.
A couple of weeks ago, he took away my paid breaks which results in 6% change to my income. He continues to find ways in which to make things worse for me.
