Made a CYS report, parent of child involved has subpoenaed me to court. is this allowed?
the report was made in regards to abuse that i witnessed at parent 1s house. parent 1 and parent 2 are in a lengthy and aggressive divorce and custody battle, and i havent heard from parent 2 since their separation MANY years ago. parent 2 subpoenad me to testify in court and requested i bring all documents in relation the the CYS report (with only two days notice). i am not a mandated reporter and was guaranteed that my identity would remain confidential. i specifically asked if i would remain confidential because there was a second report made by someone else and the case worker straight up told me her first and last name by accident. this subpoena feels very short notice and i don’t think he should be allowed to ask me about the CYS report since i was a confidential reporter. wouldn’t CYS or the caseworker be the proper person to subpoena if he wanted info on that? i don’t know if i should hire a lawyer. i want what’s best for the kids but i am very anxious about retaliation when parent 1 learns i made the report. any advice?
