Observing LTB Proceedings

Can I really just join the LTB proceedings posted by the automoderator to observe? Is there anything I should know before doing so? I am filling against my landlord at the LTB and am just interested to see how the proceedings work.

Applying for OESP Before Move-in

Hello, I recently signed a lease for a new apartment where I will be responsible for paying hydro through a submetering company.
I am eligible for OESP and was wondering if once my hydro account with the company gets set up, I will be able to apply for OESP to hopefully get the credit on my first bill, or do I need to receive the first before before applying? Thanks for any help!

Subletting—what happens to my roommates?

Edit: thank you to StatisticianLivid710 for what now seems like an obvious solution: I can just sublet to my current roommates, and then find someone who can be a roommate to them.

Hello, I am in the process of signing a one year lease, where I am the sole tenant listed on the lease. Due to my university co-op program, I expect that I will want to sublet to someone for a period of four months in the middle of my lease.

If I were to do this but my roommates wished to remain in the unit, what would our options be? What I can think of is:

  1. Get their names added to the lease so that my potential sublet would instead just be a new roommate.
  2. Convince the potential sublet to take them on as their own roommates (is this something which could be enforced?)

It seems to me that option 1 would be the best, but I would like to be aware of my options if for whatever reason my landlord refuses to add them to the lease

Key Deposit Amount

Hello, I just have a question for clarification about how much I can be charged for a key deposit.

I understand that it cannot be more than the cost of replacing the provided keys, but does that also include the cost of changing the locks? Thanks.

HRS Property Management—Illegal Lease Clauses

Just writing this to help others be aware of their rights.

i recently applied to rent from HRS property management, and noticed their lease was full of unenforceable provisions, of which I will list a few below. Even if you signed that you agree to them, if they contradict the Residential Tenancies Act, the law treats them as if they don’t exist. Talk to the studentcare legal aid team (for free!!) if you want to go to the LTB to get compensation regarding any of these infractions.

  1. You cannot be forced to pay your rent through pre-authorized payments or post-dated cheques. They must offer an alternative payment method.

  2. The rent discount they offered me for paying on time was unlawful (too much), meaning that if I did pay late, I would actually have to pay less than what they said.

  3. Their key deposit was way more expensive than what would be reasonable for replacing keys. If you paid it and would like it back, ask for justification and then apply to the LTB if they don’t give any.

  4. Failing to allow entry for an inspection is not a valid reason to charge a fee

  5. The landlord is responsible for replacing light bulbs (this is normal wear and tear) Never mind, this is on you

  6. Charging a fee for returning keys late is not valid (however they can charge you if they have already begun the process of changing the locks)

  7. Basically none of the fees in the addition terms section are valid, including charges for maintenance. All of these would need to be applied for by the landlord through the LTB. DO NOT PAY HRS ANYTHING YOU HAVENT BEEN ORDERED TO. Especially for maintenance/damages, the LTB will often award the landlord much less than they say you need to pay them in the lease.

  8. They cannot forbid you from having a pet or charge you for the privilege, however you can be evicted if your pet is limits your roommates right to peaceful enjoyment of the unit.

  9. Any provision limiting the number of nights guests may stay is void, including any charges

  10. additionally you are allowed to have extra roommates if not forbidden by municpal by-law (e.g. fire code, building standards) I don’t actually know what Waterloo has for this

  11. No matter what they say, HRS does owe you interest on your rental deposit (but not your key deposit.
