Beneficiary Problems
I am one of the beneficiaries of my 96 yr old mom’s estate. My brother is the Executor and my other brother is a beneficiary and I do not get along with my brothers at all. The will states that the household items be distributed evenly. My two brothers don’t want any items and the executor said he is going to put a price on any items I choose and that amount will be taken off my cash inheritance. He is also accusing me of illegally taking my mom’s jewelry box which is also not true as many witnesses saw the box at my house while my mom was living with us as she was palliative. My mom had asked me to bring it to her as she wanted it. I received a letter from his lawyer saying I illegally took the jewelry box and the jewelry in it is worth $50,000. She had a lot of costume jewelry which looked expensive but it was not. The whole lot was worth maybe $1000 at the very max and the week she was dying she gave me 2 of her rings and she wanted me to have her wedding ring set and my deceased dad’s wedding band. I had texted the Executor and said I will bring the jewelry box to mom’s house when probate is granted and the same time I go through her house to choose household items. The executor said he got the $50000 price as that was what it was insured for 10 yrs ago. Can he take the $50,000 off my inheritance? Can the executor put a price on the household items I take and take that off my cash inheritance?
