Is it legal for a landlord to keep a deposit for a rental if I refuse to a credit check method I never agreed to?

The landlord uses and only uses flinks to perform a credit check. They are not offering an alternative method, I offered an equifax report, and on this basis they say I refused to complete the application so they keep the deposit. They also say they never refused the application, so it is not a refusal from their part. So it is nor a yes or a no from them.

Is this legal?

Edit: this is a large developer that owns and manages many buildings in Montreal.
