DHS proposes ending the 60-day grace period
Official proposed rule (public inspection): https://public-inspection.federalregister.gov/2026-18631.pdf
What the proposal would do
If finalized, status for H-1B, L-1, O-1, TN, E-1/2/3 & H-1B1 would generally end the day after qualifying employment or activity stops. You would be considered immediately failing to maintain status unless you have another independent basis to stay.
The current rule (in place since early 2017) gives up to 60 days (or until I-94 expiration, whichever is shorter) for visa holders to find a new sponsor, change status, or leave without being treated as out of status solely because the job ended.
DHS says this restores the pre-2017 approach, better aligns the regulations with the INA (these categories are employment-tied), reduces USCIS workload from assessing the grace period on a huge volume of filings, and improves program integrity.
