New DHS Proposed EB-5 Rules
Hi Everyone,
DHS released their proposed rules for the RIA this morning. This is brand new information so I can't exactly give an in depth analysis yet. But from a high level it seems DHS is proposing increased scrutiny on the project creation/management side:
They're proposing (not limited to):
-Site visits to RC's, NCE's, and JCE's.
-Restricting the use of bridge financing
-A new investment tier for "High Employment Areas" where projects in areas with more than 150% of national employment will require an investment of 1.4 million. This does not seem to be a new reserve category and would fall under the unreservered.
-More stringent compliance for 3rd party promoters (agents etc.) to make sure they have file the I-956k
-Clarifying the sustainment period timeline and redeployment rules
-Job creation must be tied to the invested funds (but for the investor's funds the job would not be created)
This is just an initial gathering of some points I noticed. I'm sure we'll get more clarity over time. I encourage you to do your own review of the rules and please note this is not legal advice.

I got my I526E approved on May 2nd 2025 and waiting for my AOS which filed on Jan 6th 2025 along with medicals . Got EAD and AP within 3 months but waiting for AOS approval For EB5 rural filing . What would be the timeline for AOS approval from the date of I-526E approval ?

Heard EB5 EAD validity is now for 1 year only.
Can you keep renewing after that indefinitely until GC in hand?

EB5AN legit and repayments
I’ve been considering investing with EB5AN for sometime now since they have many rural projects.
Their lack of evidence for capital repayment for earlier investors concerns me. Their PPM gives too much power to the GP to reinvest funds, restructure etc making them able to hold on to the capital for a long time legally
This is in contrast to CanAm who were audited by a third party who confirmed repayments for a lot of projects. But they do not have many rural projects
Anyone else explore the capital safety net with EB5AN ? What are your thoughts?
It’s also extremely strange that there’s no public reviews of EB5AN from their investors anywhere except the ones curated on their website. One might say it’s almost curated and framed.
EB-5 Grandfathering Deadline (Sept 30, 2026)
Under the EB-5 Reform and Integrity Act of 2022, there is a grandfathering deadline that protects certain petitions if they are filed before September 30, 2026.
With only 132 days left until the grandfathering deadline, the industry wide question is if this cutoff date forces applicants to start preparing their documents early to make the deadline? Or are they willing to assume the risk of losing the protections by filing after the grandfathering deadline as we still have a legitimate program until September 30 2027?

H1B/H4 Travel Dilemma: Try for visa stamps in India or just enter using EB-5 Advance Parole?
Hey everyone, reaching out to get some perspective or hear from anyone who has navigated a similar situation.
Currents Status: Husband is on H-1B, I am on H-4. We have approved I-797 extensions valid until May 2028.
The Catch: Neither of us has a physical visa stamp in our passports right now
EB-5 Track: We filed a concurrent EB-5 Adjustment of Status in 2025. Our I-526 is approved, I-485 is pending, and we already have our physical EAD/Advance Parole (AP) cards in hand.
The Problem:
We are planning a trip to India in May 2027. We know we have to do an in-person interview since we don't qualify for drop-box. However, looking at the current appointment backlogs in India (specifically looking at Mumbai/Chennai), the standard availability is tracked incredibly far out. So we have to plan in advance for the appointment next year while we wait for our pending 485 approval.
My questions for the community:
Should we spend the energy trying to book H-1B/H-4 interview slots for May 2027 to keep our H safety net intact? Or should we just skip the consulate entirely and use our EB-5 Advance Parole to re-enter?
If we try to book the H stamps but face an admin processing delay (221g) while in India, can we safely abandon the passport/visa process and just use our Advance Parole to fly back to the U.S.?
Has anyone here safely used EB-5 Advance Parole to enter while maintaining their H-1B job without hitches?
What happens to h1b / h4 if we enter with our travel parole and no stamps . ( worried if anything goes wrong with pending 485)
Appreciate any advice or experiences you can share!

Has anyone in the GCC gone through the EB-5 process? What was it like?
Everyone's heard of it, everyone's "looking into it" but are they ready to take the step?
The EB-5 program requires an investment of $800,000 into an approved government project. By virtue of making the investment, investors obtain U.S. green card and residency for themselves, spouse and qualifying children.
The premise of the program is simple to understand, most families out if the GCC also understand the requirement for a more stable residency option, not only for themselves but for their children. The issue is that many hesitate on when to pull the trigger and start the application process.
If you have been thinking about doing the EB5 process but have not started, what are your reservations?
Is it worth applying now? Or should i pursue EB1?
Trying to decide whether to pursue EB5. If we apply today when can we realistically expect CGC in hand? I dont care about EAD/AP as we cannot use it and will continue on H1.
Pros : date is current and can file 485
Stuck in eb2 2017 backlog - so this is faster
Cons : risky especially if issue with RC, risk of money loss or gc loss. Current timelines and potential retrogression also give me pause.
Alternative : EB1 A (filing in progress but got RFE so a little discouraged). 6-7 lawyers think my case is strong. So this is a viable path for me at some point but no guarantee as every other case is being denied now.
Is anyone currently discouraged from applying given the processing timelines?
I saw on the USCIS website that the current processing time is 34+ months for the I-526E, 10 months for the EAD and 22 months for the AP.
I don’t know if there’s any scope for improvement, but have people heard from their attorneys that they expect it to worsen?
For the people that are in the process of filing or have filed recently, how do these timelines impact your decision to file?
Pursuing both eb1a and eb5 simultaneously
I am indian national eb2 pd June 2016 .
I am considering pursuing both eb5 and eb1a simultaneously. As eb1a is not certain, I would like to have eb5 has backup . I dont like current situation of h1b visa appointments and hinderence to travel. My thought process is apply eb5 now before Sept would give me EAD+AP to travel and I dont have to rely on h1b stamping. Get pressure of timeline and can give multiple attempts at eb1a, which ever path gets me pass finish line fastest . Any pitfalls in this thinking?
Received EAD but no AP yet. Normal?
I filed for EAD/AP concurrently back in Dec 2025 and received my EAD a few weeks ago (from SCOPS Texas Facility). However, I still haven’t received my AP yet.
Am I likely to get my AP soon given that the EAD was approved? I’ve heard that in many cases they’re approved together but obviously that wasn’t the case here.
We’re hoping to travel at the end of August so really hoping it comes in time.

We're planning to file our EB-5 petition before September 2026 and are currently working with a consultant who's guiding us on choosing the project, regional center, and attorney.
Before we commit, I'd love to hear from people who went the DIY route:
- Has anyone filed EB-5 without a consultant and connected with a regional center directly? How did that go, and how did you vet the regional center / project on your own?
- What are the real pros and cons of using a consultant versus doing it yourself?
One thing that's giving me pause: a few attorneys declined to take our case because we're going through these (USCIS-approved) consultants, citing a conflict of interest. Has anyone run into this? Is that a red flag about the consultant, standard caution from the attorneys, or something else?
Any experiences, lessons learned, or things you wish you'd known would be hugely appreciated. Thanks in advance!
