EB5 Promoter offering to pay part of attorney fees

I am midway into EB5 I-526 filing process. Yet to finalize a project. I am working with a promoter who is walking me through projects and introducing me to RC.

One thing he promised is that if I sign up for a project through him, he will try to get the admin fees waived or reduced, and also pay a part of attorney fees directly to attorney or send it to me in bank transfer later (upto $10k).

While waiving admin fees looks standard and I could get it written in my engagement with the RC, the attorney fees / cash back part is making me suspicious.

My attorney is ok with the arrangement and declares it in the engagement agreement but distances himself from the financial advisory/ project profitability part.

However, I am told by another promoter that such payment could be flagged as a kick back and SEC may ban such promoter and cancel all EB5 applications made with his involvement.

Has anybody encountered this?

I got my I526E approved on May 2nd 2025 and waiting for my AOS which filed on Jan 6th 2025 along with medicals . Got EAD and AP within 3 months but waiting for AOS approval For EB5 rural filing . What would be the timeline for AOS approval from the date of I-526E approval ?

I-829 Denial → Consular Processing Through EB-2/EB-3: Any Successful Experiences?

Hi everyone, I’m hoping to hear from anyone who has personally gone through, or knows someone who has gone through, a similar situation.

I was an EB-5 conditional permanent resident, and my I-829 was denied. I am now in removal proceedings and have a future Master Calendar Hearing. Separately, I have an employment-based EB-2 case with a priority date that is not yet current.
I am considering a strategy where, once my EB-2 (or potentially EB-3) priority date becomes current and consular processing is ready, I would seek voluntary departure, leave the U.S., and complete immigrant visa processing at a U.S. consulate.

I have consulted with two immigration attorneys who have different views on whether an I-829 denial results in accrual of unlawful presence following the denial decision, while the I-829 denial remains subject to review in removal proceedings.

I’m aware that unlawful presence will typically be considered and determined by a U.S. consulate during visa interviews and am curious whether anyone here has had or heard of a similar real-life experience:

• I-829 denied;
• removal proceedings initiated;
• later pursued EB-1/EB-2/EB-3 or another immigrant category;
• departed the U.S. and completed consular processing; and
• successfully received the immigrant visa without being found inadmissible for unlawful presence.

I’m especially interested in firsthand experiences with the consular interview.

Project redeployment risks

I read that EB-5 requires that your deployed investment is at-risk during cgc phase. Considering the backlog, we are looking at atleast 5-6 years before we get the cgc. Many of the projects might complete in 4-5 years. So that requires your money to be redeployed to show that it’s at-risk, while other early investors might get full return of capital. So this does a couple of things for late investors hurrying to meet the deadline:

  1. Delays your repayment of principal even after completion of project.
  2. The redeployment might be on a project that does not return the full capital.

I understand the return on this venture is the GC itself and not full return of capital. But it looks as if late investors like me, rushing to finish this process are at a disadvantage now - both in terms of reduced EAD/AP and also return of capital

why are so many people on here saying 5-8 years for cgc???

confused on this I’ve seen so many posts/comments saying it’s upwards of 5 years for conditional green card…..lawyers I spoke to are saying for rural already filed 2026 cgc should come before august 2027. just want to know

Can’t reach attorney anymore

We contacted a firm a few months ago, they assured us they can file the case before the deadline in September. They reviewed the situation and said sof would take around 3 weeks. Now we have a project selected but no idea about SOF status, the law firm either replies with generic messages or doesn't reply at all. Moreover, there was no guidance so far and none of our inquiries have been addressed during the whole time like should we use SBLOC or sell securities, etc. or whichever is better suited for the petition.

Did we make a mistake to pay over half of the attorney fee upfront? We checked with other firms before and it seems standard practice, but now starting to regret we didn't push for paying at certain milestones instead.

Has anyone else experienced this?What options do we have in this situation?

The 18 month validity on EAD and AP a deal breaker?

How are folks thinking about the EAD and AP needing to renew every 18 months? I read that due to slow processing times and no automatics extension, it’s recommended that folks apply for renewal 6 months prior to expiry.

Is the only option to stay on h1b as long as possible till you get your conditional GC?

For someone who is filing their i526 petition now before the September 30 th deadline, and considering the invisible backlog not reported to dos, it seems like conditional green card would be at least 8-10 years away. Is this still worth it?

I290b Timeline for I526e

I got my I-526E denied due to missing supporting documents, but USCIS denied the petition directly without issuing an RFE back in June of this year. I filed an I-290B appeal in July, and I’m wondering if anyone here has gone through the appeal process for an I-526E denial.

What was your timeline like? Has anyone had their I-526E approved during the Initial Field Review before the appeal was transferred to the AAO?

Also, if there is an update, such as approval during the Initial Field Review or transfer to the AAO, would the case status update appear under the I-290B receipt number or the original I-526E receipt number?

Cost effective way for investment

Those who invested the 900k or so including the fees, how did you gather the source of funds. Did you take a loan, or take a loan with your stock as collateral, use 401k, use home equity? What would be the most cost effective way to do it

How did you reconcile with the loss of money? How much do we get to lose over a period of time?
