EB3 applicant married to a person who overstayed in US

I am currently applying to EB3, but I am married to a person who overstayed in US, should I be declaring her as my spouse? in both application of MY I140 and I485. Yes, obviously I will be the applicant. Any ideas are greatly appreciated!
