Item not as described.

I’m an eBay seller myself, so I usually know the drill, but I’m currently stuck in a situation as a buyer and could use some advice on how to handle it.

I purchased an item listed as "Brand New/Sealed" specifically because it was a birthday gift. I intentionally searched for and chose a listing that specified "sealed" packaging. However, when it arrived, the packaging was clearly opened and the box severely damaged and re-taped. There was hair inside, and a note from the seller claiming this was the "last one in stock" and that I was "lucky" to get it.

When I messaged the seller to politely address the condition, explaining that because it was a gift, the sealed packaging was a requirement they became immediately hostile

They started insulting me and called me and saying that they are low income and that I'm just being "greedy." I should be happy with it because I paid so little and they lost money on it.

They claimed it was a "personal item," which contradicts the note they left in the package about having other stock.

They admitted in PMs that they opened the package "only to take photos," yet there were no photos of the open packaging in the listing It stated it was sealed in the description

I don't mind keeping the item for myself but I can't give it as a gift it works fine, and I don't want the hassle of a return but I am incredibly annoyed by the misleading description and the seller’s unprovoked rudeness and disrespect. The seller suggested a $20 partial refund instead of a full return but it has been three days and nothing.

I'm just curious if you guys think I should open the dispute. Send it fully back. Just keep the item leave a review or not to say anything about the situation. Honestly, I've never had a bad situation with eBay yet as a seller or as a buyer

I'm just more annoyed and kind of shocked by the automatic disrespect and consulting when I was asking. Just a simple question so I was curious of people's views from the outside
