I was recently involved in an accident where a van pulled out on me at a t junction, as far as im aware my bike is restricted (cbf600), however if the bike is assessed and it is found to be unrestricted what is likely coming my way?

Because Im technically not at fault, it is a third party claim and the third party mechanic isn't allowed to perform a physical inspection, only observe the inspection performed by my insurers mechanic.

Is it likely that given the circumstances they would go as far to check the bike for a restrictor, or am I in the clear?
