My MIL (79) has been in minimally assisted independent living facility for 7 years. She has MS, slight cognitive decline (I’d say about 85% there) and severe lifelong mental health issues. She has not, so far, met the criteria to be declared incompetent to make her own decisions, but she voluntarily gave POA to my husband because she couldn’t keep track of her bills.
***There is a loooooooot I’m leaving out, bc of all the history, so pls ask for clarification if something doesn’t quite add up. ***
The issue: her “friend,” who is her real estate agent, has been “helping” her the past 9 months or so. MIL has been paranoid ppl are stealing money from her bank account, so she closed all her accounts my husband had access to and refused to let him access the new ones. The agent told MIL husband was possibly stealing from her. Then the agent convinced my MIL to leave her assisted living and move back into a condo she owns in a retirement neighbourhood, on account of not having the $$ to pay for assisted living. To my knowledge, no arrangements were made for my MIL’s various needs, including supervised medicine taking. All this was done with my husband’s knowledge, against his wishes.
Five days after her move MIL is altered and in the hospital after a fall. Her glucose was over 400, bc she’s an insulin dependent diabetic. Someone anonymously called for a welfare check and EMS found her collapsed.
So. Mightily pissed at this woman’s interference, but I don’t know that she was trying to commit fraud. She was trying to help, was likely strung along by my MIL’s enthusiasm (MIL is an expert manipulator). But this could have been fatal and I would like to see where the error happened.
