Edit to say we will actually just be ignoring the notice and moving out at our own time as planned, wont be replying or anything. Since he has not informed us of our right to object, or what happens if we don't object within a month (section 9-7 of Tenancy Act), it is considered void and not a valid notice. So we'll just be ignoring it and wait for him to try and falsely evict us if we haven't left yet by September 🤣
Hello, I was hoping to get just a little input/advice for a specific part of our rights as tenants surrounding lease termination. I have already done a lot of research, and have the majority of my reply to this situation figured out, there's just one specific part that I'm getting conflicting information on and would like some help.
To preface, I'm American living in Norway for almost 4 years now, and living with my Norwegian boyfriend. The apartment we rent is in Kristiansand, part of a large house that is split into 5 apartments. The landlord lives above us, we have the apartment that is the majority of the first floor (3 bedrooms, 17k in rent, with a deposit guarantee through hybel). There have been a few things that we have required him to fix in the 9 months we have lived here, mainly things that have either broken after use, or were already not properly usable. First was a new shower a week after moving in, because the base was cracked and began to crack further with use (also it was missing a shower door when we moved in??). Second was the fan vent in the bathroom not working, as well as non-functional electrical outlets that needed to be fixed. Third was the request for the windows to be re-sealed, because they are all cracked on the outside and drafty, though this has still not been done despite being asked about at last 4 times. And most recent was a new dishwasher, after the original one abruptly dropped draining and began to leak when opening it (I suspect the pump crapped out). We have never paid rent late, and have only threatened to withhold rent once when I received no answer concerning the first request to fix the fan vent, windows and outlets. We have not received any warnings or complaints from the landlord or other tenants.
Today, we received an email terminating our lease, giving us the required 3 months notice. However, the reasons for termination were stated "unpaid deposit and planned renovations". He did not, however, inform us of our right to contest the termination, as he is legally required to (section 9-7 of the tenancy act). Thus making the termination notice not valid, which I will be pointing out.
For the deposit, that claim is a straight lie. I have screenshots of our conversations confirming that we were to do a deposit guarantee, as well as the certificate proving the guarantee was paid and approved by the landlord. I will be including all necessary links in that part of my reply to his email.
My questions stem around the claims of renovation. I do know there are different rights we have depending on the amount of renovation that he is planning, and that if it's only minor renovations then he has no legal standing to kick us out for that. If it's large-scale, that's a different story, and I'm finding conflicting information that we as tenants have to approve of it? But I still don't know if larger renovations still count as valid reasons for termination, unless it's straight up demolition or fully gutting the apartment. Though in that case, the other tenants in the other apartments here should also be told their leases are terminated as well, as it would impact the other apartments, including his own.
I'll be writing up our reply contesting the termination, starting out by pointing out that it is not legally valid, with all links and copy/pasted sections to the Tenancy Act within the week, so I want to make sure I have all my information together so it's as professional of a "fuck you, you have no reason to kick us out" as possible. We have already been planning on moving after the summer anyway, but it will be on our terms, not because he's lying in order to kick us out.
Basically, I need help getting the correct information around our rights as tenants if he wants to terminate due to renovation, as I can't find a solid answer. Does he have the right, and is he required to tell us the extent of the renovation to prove it's valid?
