We have not vacated our property. RTA have allowed real estate to claim our bond back. We haven’t done hand over or the vacating property procedures, nothing. They used a fake false rental arrears claim which we told the RTA but they won’t do anything. This feels procedurally wrong and illegal and yet it’s happening.
Has anyone successfully challenged the entry report photos in a bond claim? We have photos dated and timestamped 3 days after they did their entry report photos. Our photos show a significant change in the gardens, lawns and even plants that don’t exist in garden beds. We think they’ve used the tenant before us entry photos. It is an online photograph and entry report so we can extract the metadata to find out when the photo was taken for their entry report. Yes we know we should have picked up on it but we missed it when we did our upload of entry report photos because it was night time.
Anyone successfully challenged the entry report photos as no reliable or accurate?
We won at QCAT and are owed 12k by the owners of the property. What’s our enforcement ability? I’ve been told there’s no ability for any enforcement beyond another court order but this time from the magistrate court. Apparently there’s no ability to have a warrant of execution only a money order which is just another order to pay but nothing can be done to the owners or the real estate to make them pay us? Is this true? It reads that all other small claims are allowed to have enforcement against the debts owed except tenants.
We are not able to stay and claim rent free as the property is not safe to live in.
