We live in a country where insurrectionists have been broadly pardoned, child rapists are protected by our Federal Department of Justice, and a sports hero has been arrested for dipping his hand in the water of the Reflecting Pool.

Have we kept our Republic?

Study how to examine and cross-examine

Got a prejudgment remedy granted in a case where the defendant had purchased from my client a Caribbean market in a Caribbean neighborhood with no street parking, changed it up to an Ecuadorian bodega, lost all the business, and then blamed my client for the business failure and defaulted on my client's seller financing.

It was not a hard case to make, and I made most of it on cross-examination of my brother counsel's client. Brother counsel's cross of my client was floundering and generally helpful to my cause.

Two lessons for trial lawyers:
• be careful about the scope of direct examination
• study cross-examination. I recommend the Pozner and Dodd book, it's been quite helpful to me.

Does anyone else find litigation *less* stressful than transactional?

Not really seeking "help" with this ­— the new flairs are dumb — but just a comment on the profession. What I have found is that transactional work involves a lot of unscheduled surprises and people failing to meet deadlines, and as the attorney trying to close the deal for the client, it's all MY problem. Including opposing counsel / client being a dick, own client being feckless, etc. V. stressful.

Litigation, on the other hand, I find opposing counsel tend to be less stressed and more pleasant, which makes that part of my practice easier to handle and less stressful. Clients also are more respectful of court deadlines than they are of the "deadlines" they set for themselves. And if they blow a discovery deadline or whatever, nobody is particularly angsty about the first extension. So again, less stress.

Anyone else feel this?

Filed a motion to default for failure to plead. In CT that's pretty straightforward to respond: you file an answer, a motion to dismiss, or a motion to strike, then the clerk denies the motion to default and we move on.

Not this OC. Nope. He files an *objection* to the motion to default.

How do we feel about AI transcription being used in police investigations?

Recently got in a LinkedIn discussion about pro se using AI (hate it) … and someone raised the issue of police using AI transcription on recorded audio … (also hate this)

My position is that if you're doing something that could deprive a person of their liberty, there must be a human who's accountable for doing that thing; it's not ok to push the procedure onto an autonomous machine.

Thoughts?

Are you transactional, litigious, or both?

I currently cover both sides of the v for small business and i.p. disputes, as well as small business sales and purchases and contracts. Overall I prefer litigation because it's a different type of stress than transactions. What's everyone else think?

I practice in CT. We serve, then file. It seems like every out-of-stater does it backwards and gets confused when I tell them the right way.
