Need family law advice
Hello, first time poster, I'll try and make this as straight to the point as I can, but theres just a lot. To start with some backstory my (34F) (hopefully soon to be ex) husband (43M)and I got married in 2023 and we have one child together (10F). Live in Tennessee. I got us in our current house using inheritance money back in 2019 and have paid every mortgage payment since.
Back in January he lost his full mind I guess and it resulted in a DV, my child and I being trapped in our house until the last day where he chased my child and I through the house with a firearm to his head. At which point I was able to sneak out of the house with child into a friend's car while cops were alerted and we couldnt go home for days. He was arrested a few days later and is still incarcerated for a while. I have an active protection order and so does my child.
I found a realtor willing to work with me to sell my house (he went to the jail and got signatures from husband allowing sale). Which I'm sure I'll have to split it (even though "husband" hasnt put anything into the house other than paying utility bills).
Point of all this being, I'm trying to figure out if im able to use my half of the money when my house sells so I'm able to get my child and I a safe place to live that I can actually afford, or if I have to wait for divorce to be finalized. I would really be heartbroken if I got us into a safe place and stabilized and then all of a sudden during divorce court I'm forced to sell because it could be considered marital property. I've been trying to find an attorney willing to work with me or even willing to take partial payments due to finances being extremely stretched until the sale of my current house.
