Bought a car from CarMax that had an undisclosed plug in the side wall

I bought a 2021 BMW 330i from CarMax on December 27th. Everything with the car has been great, no complaints about the buying process or how she runs at all. Recently noticed a slow leak in my rear driver tire. I took it to a tire shop to see if it could be replaced (run flats can’t be plugged). Turns out I have a nail in my tire which is fine… but they also told me the tire had been plugged in the past. In its sidewall at that!
Here’s where it gets weird, I bought the car with 38k miles on it, so one of my questions when buying were “is there any chance I can get new tires on before purchase?” I asked because I knew tires would be on the horizon soon, and they had likely not yet been replaced because of lack of wear. The salesman made sure to let me know they put new tires on the car before sale, so I (stupidly) believed him after a quick look and went on about my day.
I know I have a nail in the tire which is user error and I’ve had the car for 6 months, so not focused on either of those things… I want to know if I have any legs to stand on with them selling me a tire that had its sidewall plugged and lying about the tires being new! I called and the service dept said they wouldn’t be able to do anything with the tire except confirm the sidewall had been plugged, and it’d take two weeks for them to see me.

Tl;dr bought a BMW 330i from CarMax, was told new tires were put on pre-sale. Six months later, a tire shop finds a prior sidewall plug on one tire meaning it was never new. CarMax service says 2 week wait to see if sidewall plug is actually there.
